What you need to know

Pricing

Our Scarborough process servers generally offer up to 3 attempts, with an average of about $100 for all of them. If you want the process server to make only one attempt to serve your legal document, then the price is cheaper than that. Keep in mind that mileage for first, second and third attempt is often charged.

Court Runner charges a fee of $60 regular service. This fee doesn’t include mileage cost, HST, and insurance. If you choose to email your documents, you will be charge for printing.

What is an Affidavit of Service?

Once you’ve handed over the documents to any of our Scarborough process server. they will proceed to serve the documents on the respondent. If they are successful, they’ll fill out a form known as the Affidavit of Service. This is extremely crucial, as it is the paper confirming the recipient (party or individual) has received them, and the details thereof. Even if they are unsuccessful, they still need to fill out an affidavit of attempted service .

Once you receive the Affidavit, unless you have additionally requested the process server to file the document in court themselves, you’ll need to head over to the court clerk to file it yourself.

What happens if I can’t serve the respondent/defendant?

It sometimes happens that our Scarborough process server is unable to locate the person or party in question and is unable to serve the documents. Since everybody has different schedules, timetables and things to do throughout the day, this happens more often that you’d think.

Process servers are required to show their due diligence – that they tried everything they could to hand over the documents to the receiving party, so that they can provide that to the court. In the case where they are ultimately unable to deliver, the court will not be able to advance due to lack of jurisdiction. You will then be notified of actions to take through the APP or email if you ordered through our website.
