What If the Party can’t be served?
This is something that is bound to happen. People can be unpredictable on the best of days, so there will be times when even professional London process servers won’t be able to serve them with the documents.
In these cases, depending on the attempts, you will be notified, and due action will be taken. If this is the first attempt of several, then you would have to make another attempt to serve the receiving party. If this was the last agreed-upon attempt, then the process server will fill out an Affidavit of Attempted Service (ATS) — explaining that they did everything in their power to try and serve the documents). This ATS document will be notarized. After that, you will have to take the ATS to the court for further action.
