What is an Affidavit of Service?

The affidavit of service (AOS) is proof that the process server served the respondent/defendant with the documents (assuming he was successful). If the Alberta Process Server is not successful in serving the documents on the respondent/defendant – they still have to fill out an affidavit of attempted service and have it commissioned by a notary public or commissioner of taking affidavits.,

After the Process server fills and commissions the AOS, depending on the arrangement, he may send the original copy of AOS to the plaintiff to file it in the court or he may assist the plaintiff in filing it in the court for an additional service fee. Lack of filing the AOS can hinder the lawsuit or action to proceed.

You do not need to sign an affidavit of service. The defendant also do not need to sign the AOS. Outside of this, the process server themselves (or Court Runner) will let you know what documents require signature.

How Soon can I get my Documents Served?

Our Alberta process servers will outline their delivery schedules. Depending on the type of services you select when you are ordering a service of process using the court runner app. You can choose same-day or next-day service. If you select same day, the documents will be served on the same day. This will of course incur additional costs, but there are times and court cases in which time is key and making sure everything is organized and served quickly is worth the money.

While not all process servers in Alberta offer this, many may also have a scheduled serving option, where you can reserve a day and time for them to serve the papers. In large lawsuits with multiple parties involved, having everyone served in a set time frame can be extremely beneficial.
